dc.description.abstractİdari uyuşmazlıklarda alternatif çözüm yolu olarak değerlendirilebilecek başvuru yolları, yargı yerine başvurulmaksızın ve onun dışında uyuşmazlıklara çözüm üretilmesi olarak ifade edilebilir. İşte bunlardan biri de Kamu Denetçiliği Kurumudur. İdari rejimin geçerli olduğu ülkelerde Kamu Denetçiliği sisteminin etkisi, daha çok tamamlayıcı niteliktedir. Kamu Denetçiliği Kurumu'nun istek, dilek, temenni ve şikayetler için başvuru yeri olarak algılandığı, bu yöndeki başvuruların sayısının giderek arttığı, ihtilafların devam etmesi halinde ise Kurum tarafından verilen kararların yerine getirilmemesi halinde idari yargıya başvuru yolunun açık olduğu görülmektedir. Kamu Denetçiliği Kurumu'nu saygınlığının temeli aslında tarafsız ve bağımsız olmasıdır. Bu özelliği ile kamu görevlileri üzerinde olumlu psikolojik etkiler yaptığı için tercih sebebidir. Kamu Denetçiliği Kurumu'nun diğer denetim mekanizmaları yanında tercih edilmesinin gerekçesi ise, hem kısa zamanda harekete geçebilecek bir denetim mekanizmasına sahip olması hem de yerindelik denetimini yapabilmesidir. Bu çalışmanın amacı Kamu Denetçiliği Kurumu'na ülkemizde ihtiyaç olup olmadığının ortaya konulmasıdır. dc.description.abstractIt is possible to remark that the remedies that may be assessed as alternative resolution in administrative disputes are the generation of a resolution outside of place of jurisdiction without applying to judicial authority or without judging from judicial activities. For this reason, the Public Inspection Institution appears before us. Although the perfection has never been approached in the inspection of the Administration within the countries with Administrative Regime, the impact of Public Inspection System in these countries has a supplementary character. The basis of the reputation of an the Public Inspection Institution, in fact, that is impartial and independent. With this feature, a positive psychological effect for public officials are preferred. The rationale for preferring an the Public Inspection Institution in addition to other control mechanisms, control mechanism that can move both in terms of appropriateness in a short time have control. The aim of this study is to demonstrate whether our country needs the Public Inspection Institution.
